These terms and conditions (the “Terms and Conditions of Purchase”) apply to all tickets sold by Tickster (the “Ticket Provider”) on behalf of Hafjell-Kvitfjell Alpin AS (the “Organiser”) to purchasers (the “Purchaser”).

REFUNDS AND CHANGES

Right of Withdrawal

The purchase is exempt from the right of withdrawal pursuant to Section 22(m) of the Norwegian Right of Withdrawal Act (leisure activities provided on a specific date). This means that the purchase becomes binding once payment has been completed and that, from that point onwards, the Purchaser is not entitled to claim a refund of the ticket price.

Cancellation and Other Changes

The Organiser reserves the right to make changes to the programme, time and date of the event. In the event of minor changes, including a change of time or date, the ticket will remain valid for the rescheduled time or date, and such changes do not entitle the Purchaser to a refund.

If the event is postponed due to circumstances beyond the Organiser’s reasonable control (force majeure), including weather and snow conditions, orders issued by public authorities, restrictions, strikes or similar circumstances, the ticket will remain valid for the rescheduled date. If a new date is not set within three (3) months of the original date, the Purchaser is entitled to a refund of the ticket price. The ticket fee will not be refunded.

Any claim for a refund must be submitted to the Organiser in writing within thirty (30) days after the cancellation has been announced. Any liability of the Organiser for damages shall, in all circumstances, be limited to the ticket price.

GENERAL INFORMATION

The Ticket

The ticket grants admission to the relevant event provided that the barcode or other identifying code on the ticket is valid and legible. The ticket may not be copied or used more than once. The Purchaser is responsible for ensuring that the ticket in their possession is valid and legible.

Age Restrictions

The Purchaser is responsible for checking the age restrictions applicable to the relevant ticket. The Organiser will not refund tickets if the Purchaser or any other intended attendee does not meet the age requirements applicable to the relevant ticket type.

Transfer

The ticket may be transferred to a person other than the Purchaser unless otherwise stated at the time of purchase. The Purchaser accepts that the ticket may not be resold at a price higher than its face value. In the event of a breach of this condition, the Organiser may cancel the ticket without a refund.

Loss of Ticket

The ticket serves as proof of admission. Lost, stolen or unused tickets will not be replaced or refunded.

Other Rules

The Purchaser is required to comply with all applicable laws and regulations, including rules relating to alcohol and infection control, as well as any rules and instructions established by the Organiser to ensure safety and order at the event. If the Purchaser breaches any applicable rules or regulations, the Organiser has the right to remove the Purchaser from the event without refunding the purchase price.

Privacy

The Organiser is the data controller responsible for the Purchaser’s personal data. The Organiser processes personal data in order to administer ticket sales, provide the Purchaser with access to the event and keep the Purchaser informed about the event (for example, in the event of changes or a ticket transfer).

The legal basis for the processing is the performance of the contract (including these Terms and Conditions of Purchase), pursuant to Article 6(1)(b) of the GDPR. Full information about the processing of personal data, including the Purchaser’s rights of access, rectification and erasure, is set out in the Organiser’s Privacy Policy

The Ticket Provider acts as a data processor on behalf of the Organiser when carrying out ticket sales. The Ticket Provider may also have its own legal basis for processing the Purchaser’s personal data. In such cases, the Ticket Provider acts as a data controller. The Organiser recommends that the Purchaser familiarise themselves with the Ticket Provider’s privacy policy and terms and conditions of purchase, or contact the Ticket Provider for further information about its processing of personal data.

Governing Law and Dispute Resolution

These Terms and Conditions of Purchase are governed by Norwegian law. Any disputes between the Purchaser and the Organiser shall first be sought resolved amicably.

The Purchaser may also contact the Norwegian Consumer Authority (Forbrukertilsynet) at forbrukertilsynet.no for guidance.

If an amicable resolution cannot be reached, the dispute may be brought before the ordinary courts of Norway in accordance with the applicable rules on legal venue.
